TERMS AND CONDITIONS OF SALE TO INDIVIDUALS - ONLINE AND DISTANCE SELLING

These terms and conditions of sale are agreed between HORSE PILOT, a company with capital of €177,490, whose registered office is located at CYSOING (FRANCE), registered in the Marseille Trade and Companies Register under number 527 876 445, hereinafter referred to as “HORSE PILOT,” and, on the other hand, by any natural or legal person wishing to make a purchase via the “HORSE PILOT” website, hereinafter referred to as “the buyer.”

Purpose

These terms and conditions of sale are intended to define the contractual relationship between HORSE PILOT and the buyer and the conditions applicable to any purchase made through the HORSEPILOT.COM merchant site, whether the buyer is a professional or a consumer. The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these terms and conditions of sale.

These terms and conditions of sale shall prevail over any other general or specific terms and conditions not expressly approved by HORSE PILOT. HORSE PILOT reserves the right to modify its terms and conditions of sale at any time. In this case, the applicable terms and conditions will be those in force on the date of the buyer's order.

Characteristics of the goods offered

The products offered are those presented on the HORSE PILOT website. These products are offered while stocks last.

The photographs on the website are as accurate as possible, but cannot guarantee a perfect similarity with the product offered, particularly with regard to colors.

Prices

The prices listed on the website are inclusive of VAT in euros (or in the currency of the selected country, i.e., US dollars, CA dollars, AUS dollars, NZD dollars, British pounds, Swiss francs, Danish kroner, Norwegian kroner, Swedish kronor, Japanese yen, etc.) and take into account the VAT applicable on the day of the order. Any change in the rate may be reflected in the price of the products or services. HORSE PILOT reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated include order processing, transport, and delivery costs, provided that they take place in the geographical areas specified below.

Orders

Buyers who wish to purchase a product must:

  • Fill in the identification form with all the requested information;
  • Confirm their order after checking it;
  • Make payment in accordance with the terms and conditions;
  • Confirm their order and payment. Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgment of full knowledge of them, and waiver of the right to invoke one's own terms and conditions of purchase or other conditions.
  • All the data provided and the recorded confirmation will constitute proof of the transaction.
  • Confirmation will constitute signature and acceptance of the transactions carried out. The seller will send confirmation of the recorded order by email.

Withdrawal

Buyers who are non-professional individuals have a withdrawal period of thirty days from the delivery of their order to return the product to the seller for exchange or refund without penalty. Products returned or exchanged must be new and in their original packaging.

For customizable products, made to the customer's specific request, such as the customizable competition jacket, the customer has two days to report a size issue and request an exchange for a different size. The colors, models, and finishes of the jacket cannot be changed when changing sizes. No refunds will be possible as the product is manufactured to the customer's specific request.

Return/exchange labels are managed by Horse Pilot. For the United States, returns/exchanges should be sent to the following address: Lawrenceville Georgia 30046 USA. For the rest of the world, returns/exchanges should be sent to the following address: 59830 Cysoing, FRANCE.

Sales promotions

Please note that during temporary sales promotions (special offers, sales, BOX sets, etc.), HORSE PILOT may apply special conditions. These may change delivery times (due to high order volumes, delivery times may be extended to 2 to 5 business days) or the return method, which may exceptionally be at the customer's expense. If these special conditions are changed during said sales promotions, they will be specifically displayed on the product page of the website next to the “Add to cart” button . These conditions shall prevail at the time of purchase.

Payment terms

The price is payable upon ordering.

Payments shall be made by:

  • Bank transfer (our bank details required for the transfer will be provided to you when your order is confirmed)
  • Credit card via 3D Secure
  • PAYPAL - the precise list of accepted credit cards is provided to the customer during the payment process. If the customer has a PAYPAL account, they can log in and make the payment directly. Depending on your country, PAYPAL offers payment in several installments at no extra cost.
  • ALMA - By paying in 2 or 3 installments at no extra cost, you can spread the cost of your purchase over 2 or 3 equal payments. Each payment will be automatically collected from the credit or debit card specified when you pay for your online purchases.
  • APPLE PAY - Apple payment system (via your Macbook, iMac, iPhone, or iPad, etc.)
  • Gift cards or promotional vouchers purchased online via our website are non-refundable.

The buyer's account will only be debited for the amount of the products ordered and at the time the customer confirms their order. At the buyer's request, a paper invoice showing the VAT will be sent to them.

Pay in 3 installments with Alma

What is Alma?

Alma is a French payment solution that allows you to pay for your purchases in several installments by credit card. Alma manages your payment from start to finish and offers you the option of paying in 3 installments with no fees at many partner online stores.

How does the 3 interest-free installments with Alma work?

The 3 interest-free installments with Alma allow you to spread the cost of your order over three equal payments.

The first payment is taken when Horse Pilot confirms your order. The next two payments are then taken automatically, usually 30 days and 60 days after the order date.

The payments are taken from the credit card used for the payment. Alma will send you a summary schedule.

Am I eligible to use the 3 interest-free installments payment method?

To be able to pay in 3 interest-free installments with Alma, you must:

  • be of legal age,
  • use a valid credit card accepted by Alma,
  • make a purchase that is eligible for split payment.

Acceptance of payment in installments is subject to Alma's analysis at the time of ordering. The minimum and maximum amounts may vary depending on the store.

What information do I need to provide when making my purchases?

To pay in 3 installments with no fees with Alma, you will need to provide:

  • your email address,
  • your billing address,
  • your credit card information.

This information is necessary to process your order and send you the payment schedule and communications related to your payment.

What are my payment options with Alma?

The 3 interest-free installments are automatically debited from the credit card used when placing the order.

The first payment is taken when the order is confirmed, and the next two according to the schedule provided by Alma.

You will receive information about your payments by email.

What happens if I cancel my order or request a refund?

In the event of a cancellation or return accepted by Horse Pilot, Alma will cancel the remaining payments and refund any amounts already debited.

The refund will be made to the credit card used for the purchase, according to your bank's usual processing times.

What happens if I don't pay for my order?

If the payment fails on the scheduled date, Alma may make further attempts and contact you to resolve the situation.

It is important to ensure that your credit card is valid and has sufficient funds until the final payment date.

Deliveries/packaging

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. The risks are borne by the purchaser from the moment the products leave the premises of HORSE PILOT.

In the event of damage during transport, a reasoned complaint must be made to the carrier within three days of delivery. Delivery times are given for information purposes only; if they exceed thirty days from the date of the order, the sales contract may be terminated and the buyer reimbursed. Customizable competition jackets come with a Horse Pilot transport cover.

HIPLI delivery terms

The Hipli service offers a reusable package that combats e-commerce waste. Products ordered by the Customer, excluding personalized products, will be delivered within a maximum of 10 working days after the order has been approved. The delivery time for each order is specified in the order confirmation issued by the service provider. Deliveries are made from Monday to Friday. Delivery times are in working days, except in cases of force majeure. It is specified that the above-mentioned delivery times are not binding. Consequently, the service provider cannot be held liable to the buyer in the event of a delivery delay not exceeding 72 hours. In the event of a delay exceeding 72 hours, the buyer may request cancellation of the order. Any deposits paid will then be refunded by HIPLI. HIPLI cannot be held liable in any way for delays or suspensions of delivery attributable to the buyer or in cases of force majeure.

Place and Terms of Delivery

Delivery will be made to the address indicated by the buyer on the order form by handing over the Products to the buyer. Any redirection due to an incorrect or incomplete address will be charged to the buyer. All deliveries will be accompanied by a delivery note. The buyer shall ensure that the service provider or carrier designated by them or acting on their behalf has access, particularly if they are not personally present on the day of delivery. The service provider undertakes to deliver Products that comply with the order and in packaging that is sufficient to preserve their integrity. The service provider reserves the right to make partial and/or early deliveries of the Products. Shipments will be made by carrier partners external to the service provider.

Reservations

Upon receipt of the Products, the buyer, on behalf of the service provider, shall check, in the presence of the carrier, that the Products delivered are in good condition. In the event of loss or damage upon receipt, the buyer shall issue any reservations in accordance with Articles L. 133-3 et seq. of the French Commercial Code, in order to protect the interests of the service provider.

Ownership

Delivery does not entail any transfer of ownership, as the items ordered are only made available for the purpose of shipping the buyer's items to its own customers. However, this clause does not prevent the risks of the delivered products from being transferred to the buyer upon delivery to the buyer and until their delivery to the buyer's customer or their return to the buyer by the latter's customer.

Warranty

All products supplied by the seller are covered by the legal warranty provided for in Articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, it may be returned to the seller, who will take it back, exchange it, or refund it. All complaints, requests for exchange or refund must be made by post to the following address: Horse Pilot – 350 Rue de la Muque - 59830 CYSOING within thirty days of the delivery date.

Airbag Maintenance

Maintenance of the Airbag Product is recommended every year or after 5 deployments. This paid service consists of a visual inspection of the various components of the Product, a check of the activation mechanism, and pressurization of the airbag module.

The refill/cartridge is not replaced; when ordering maintenance, the Customer is reminded that a replacement refill/cartridge must be ordered separately if necessary. Maintenance does not extend the Product's warranty (legal or commercial).

Shipping and return costs are the responsibility of the Customer. The maintenance period may vary from a few days to a few weeks if the maintenance involves a repair that has been previously authorized by the Customer by accepting the quote.

Liability

The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, service interruption, or other unintentional problems. Intellectual property All elements of the HORSE PILOT website are and remain the exclusive intellectual property of HORSE PILOT.

No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site, whether software, visual, or audio. Any simple or hypertext link is strictly prohibited without the express written consent of HORSE PILOT.

Personal data

In accordance with the French Data Protection Act of January 6, 1978, personal information relating to buyers may be subject to automated processing. HORSE PILOT reserves the right to collect information about buyers, including through the use of cookies, and, if it wishes, to pass on the information collected to commercial partners.

Buyers may object to the disclosure of their contact details by notifying HORSE PILOT. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978.

Archiving/Proof

HORSE PILOT will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code. HORSE PILOT's computerized records will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.

Dispute resolution

These online terms and conditions of sale are subject to French law. In the event of a dispute, jurisdiction is assigned to the competent courts of Marseille, notwithstanding multiple defendants or the introduction of third parties.
